Consumer Terms of Service

These terms are the agreement between you and SeptemberAI for your personal use of BAP, our Powerful AI for Work. They set out what you can expect from us and what we ask of you. We have written them in plain language so they are easy to follow.
SeptemberAI and BAP
SeptemberAI, operated by September Platforms Private Limited, is an AI research and development company. BAP is our Powerful AI for Work. These Consumer Terms are a binding agreement that governs your personal use of BAP and our related sites, apps, and services, which we call the Service.
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Personal use versus organizations
These Consumer Terms cover individuals using the Service for their own personal use. They are the right terms for you if you signed up for yourself.
If you use the Service for, or on behalf of, an organization, our Commercial Terms apply instead of these Consumer Terms.
Signing up and staying secure
You must be at least 18, the age of majority in India, to use the Service. When you create an account, give us accurate information and keep it current.
You are responsible for the activity under your account and for keeping your sign-in details secure. Do not share your credentials with anyone. If you notice unauthorized use of your account, tell us promptly so we can help. You can close your account at any time.
Acceptable use
You may use the Service for lawful purposes and in line with these Terms. You agree not to:
- break the law or infringe the rights of others;
- generate or spread malware, spam, or harmful, deceptive, or abusive content;
- reverse engineer, disrupt, or gain unauthorized access to the Service or its systems;
- scrape or extract data beyond what your use of the Service permits;
- circumvent usage limits, rate limits, or security controls;
- use the Service to build a competing product by extracting its models or data.
We may suspend access where we reasonably need to protect the Service, its users, or third parties.
Our Usage Policy sets out these acceptable-use rules in full, and it applies whenever you use the Service.
What you put in and what you get out
You keep the rights in the content you provide to the Service, which we call your inputs. Subject to your compliance with these Terms, we assign to you our rights in the outputs the Service generates for you.
You confirm that you have the rights needed to submit your inputs. BAP relies on AI systems, and their output can be inaccurate or incomplete, so please review results before you rely on them.
How we handle your data is described in our Privacy Policy. Where we offer controls, such as opting out of using your content to improve our models, you are free to use them.
Suggestions you send us
If you rate outputs or send us suggestions, we may use that feedback to improve the Service. We can do this without any obligation or payment to you.
Plans and billing
We offer free and paid plans. Paid plans are billed in advance on a recurring basis and renew automatically until you cancel. You authorize us to charge your payment method for the fees plus applicable taxes, including GST.
You can cancel at any time, and cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where the law requires otherwise. We may change pricing with reasonable advance notice, which applies to your next renewal.
Where you purchase through an app store, that store's terms may also apply. Nothing here limits the rights you have under the Consumer Protection Act, 2019.
Tools you connect
The Service can connect to third-party tools and models that you authorize. Your use of them is governed by their own terms and privacy policies, and we are not responsible for them.
You are responsible for the permissions you grant and the data you share with those third parties.
What you submit and generate
You are responsible for the content you submit and generate using the Service. We may remove content that breaks these Terms, the law, or the rights of others.

How the Service changes
We may update the Service and its software over time, sometimes without notice. Some features may be offered as previews or beta and are provided as is.
Any open-source components are governed by their own licenses.
What we own and what you may use
The Service, including its software, design, and trademarks, is owned by September Platforms Private Limited and its licensors.
These Terms grant you a limited, non-exclusive, non-transferable right to use the Service.
Limits on our responsibility
The Service is provided as is and as available, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. AI output can be wrong, and you are responsible for reviewing it. We do not warrant that the Service will be uninterrupted or error-free.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the six months before the event and INR 8,000.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Indian law.
Covering losses from misuse
You agree to cover reasonable losses we incur from your breach of these Terms, your misuse of the Service, or your violation of the law or the rights of others.
How we update this agreement
We may update these Terms. For material changes, we will update the Last updated date and, where appropriate, give additional notice.
If you keep using the Service after changes take effect, that means you accept the revised Terms.
Where and how disputes are resolved
These Terms are governed by the laws of India. If a dispute comes up, we will try to resolve it with you in good faith first.
Failing that, disputes will be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat at Coimbatore, Tamil Nadu, India, before a sole arbitrator, conducted in English. Subject to that, the courts at Coimbatore, Tamil Nadu, India have exclusive jurisdiction.
Nothing here affects rights you cannot waive under the Consumer Protection Act, 2019 or other applicable law.
